Terms of Service

You understand that you have no right to any CBC archive materials until you have entered into a licensing agreement and paid all related fees. All access to and use of CBC Archive Sales is governed by the following Terms of Service:

Process

  1. When submitting a request, please provide a precise description of the materials you are looking for. We cannot search for material on a general theme or era. It is your responsibility to specify the context or content of the archives to be used.
  2. You will be required to enter into a CBC licensing agreement prior to the release of high-resolution archive materials.
  3. Screeners will be provided in low-resolution with burned-in timecode. They are solely for internal, non-commercial use and must not be exhibited publicly.
  4. CBC reserves the right to view all screener selections in context prior to releasing high-resolution footage.

Rates

  1. By submitting a request, you agree to pay a) all research and dubbing charges related to the material ordered and b) a minimum fee whether or not the material is included in the final edit. This fee shall be based on the licence fees applicable to the market and territories indicated on the rate card . You agree to provide CBC with billing information for outstanding charges.
  2. Upon entering into a licensing agreement with CBC for CBC archive materials, you agree to pay the full licence fee quoted by CBC in addition to any administrative fees. All rates will be subject to applicable taxes.
  3. All licences originating from outside of Canada will be charged in US dollars.
  4. The rate for sports footage will be twice the posted rate and is for access only.
  5. The rate for CBC archive materials which include journalist audio or video content will be twice the posted rate.
  6. CBC has the right to modify its rates at any time.
  7. You are responsible for all costs associated with clearances and consents from third parties whose rights may be affected by your use of the CBC archive material. Where applicable, you will obtain the release of mechanical and or synchronisation rights, plus all necessary approvals and permissions from The Writers Guild of Canada, AFM Canada, ACTRA and or any other rights holder. You agree to provide to CBC Archive Sales proof of such releases and clearances prior to any use of CBC archive materials.

Access

  1. CBC only provides “natural” or “wild” sounds.
  2. CBC does not own all material in its archive. In such cases, material not owned by the CBC may be unavailable.
  3. Scripted footage may require signed talent clearances.
  4. Identifiable shots of the general public may be restricted.
  5. Use of archive materials where a public figure or a recognizable, private individual appears may require the consent of that public figure or individual. In such cases, you are responsible for acquiring such consent.
  6. CBC has the right to restrict or refuse the use of archive footage at its sole discretion.
  7. Use of news content must be in accordance with the Journalistic Standards and Practices and may be subject to final approval by CBC News.
